Sharjah Ruler issues Emiri Decree establishing Public Prosecution

Sharjah 24: His Highness Sheikh Dr. Sultan bin Mohammed Al Qasimi, Supreme Council Member and Ruler of Sharjah, issued an Emiri Decree establishing the Public Prosecution in the Emirate of Sharjah.
The Decree stipulated that a judicial authority shall be established in the Emirate of Sharjah, called the “Public Prosecution”, which shall assume the authority of investigation and accusation before the competent courts in the Emirate and any other powers assigned to it by the Judicial Council. It shall enjoy the legal personality and legal capacity necessary to achieve its objectives and exercise its powers, and shall have financial and administrative independence and be affiliated with the Judicial Council.

According to the Decree, the Public Prosecution shall consist of a Public Prosecutor assisted by a number of public attorneys, heads of the Public Prosecution, their deputies and assistants, and their appointment shall be issued by Emiri decrees or decisions of the Judicial Council - as appropriate.

A law shall be issued to regulate the authority of the Public Prosecution in the Emirate of Sharjah in accordance with the legislative procedures followed in the Emirate.

The Decree specified the transitional provisions as follows:
1. The public attorneys, heads of the Public Prosecution, their agents, assistants, and the administrative and technical staff of those on the federal staff affiliated with the Ministry of Justice, who are determined by the Judicial Council based on the proposal of the Attorney General, shall be transferred to the Public Prosecution, taking into account Cabinet Resolution No. (46) of 2019.
2. All its assets, contracts, rights, obligations, accounts, technical and technological systems, and all its work, tasks, documents, and properties located in the Ministry of Justice shall be transferred to the Public Prosecution.
3. A joint committee between the Government of the Emirate of Sharjah and the Federal Supreme Judicial Council shall supervise the transfer process, and the committee shall submit its reports and recommendations to the competent higher authorities.
4. The work in the judicial system in the Emirate of Sharjah shall continue in accordance with the regulations followed in the Ministry of Justice during the transitional period until the issuance of the law regulating the Public Prosecution in the Emirate of Sharjah and the completion of the transfer process.
