Sharjah Ruler issues Emiri Decree establishing Judicial Department

Sharjah 24: His Highness Sheikh Dr. Sultan bin Mohammed Al Qasimi, Supreme Council Member and Ruler of Sharjah, issued an Emiri Decree establishing the Judicial Department in the Emirate of Sharjah.
According to the Emiri Decree, a department shall be established in the Emirate of Sharjah called the “Judicial Department”. It shall have the legal personality and legal capacity necessary to achieve its objectives and exercise its powers. It shall have financial and administrative independence and shall be affiliated with the Judicial Council in the Emirate of Sharjah. It shall be responsible for organising and following up on the work of courts of all types and levels and judicial services in the Emirate in a manner that ensures the achievement of justice and the independence of the judiciary.

The Emiri Decree stipulated that a law be issued to regulate the judiciary and the Judicial Department in the Emirate of Sharjah in accordance with the legislative procedures followed in the Emirate.

The Emiri Decree specified the transitional provisions as follows:
1. Members of the judiciary, judicial assistants, and administrative and technical staff who are on the federal staff affiliated with the Ministry of Justice, who are determined by the Judicial Council based on the proposal of the chairperson of the department, shall be transferred to the Judicial Department, taking into account Cabinet Resolution No. (46) of 2019.
2. All of its assets, contracts, rights, obligations, accounts, technical and technological systems, and all of its work, tasks, documents, and properties located in the Ministry of Justice shall be transferred to the Judicial Department.
3. A joint committee between the Government of the Emirate of Sharjah and the Federal Supreme Judicial Council shall supervise the transfer process, and the committee shall submit its reports and recommendations to the competent higher authorities.
4. Work in the judicial system in the Emirate of Sharjah shall continue in accordance with the regulations followed in the Ministry of Justice during the transitional period until the issuance of the law regulating the judiciary in the Emirate of Sharjah and the completion of the transfer process.
